1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and HoloCloset ("HoloCloset," "we," "us," or "our") governing your access to and use of the HoloCloset website, web application, APIs, and browser extension (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

HoloCloset is an AI-powered virtual closet and try-on service. The Service allows you to:

• Create and manage a digital avatar.
• Upload or capture clothing items and outfits, including via our Chrome extension.
• Organize outfits and maintain a virtual closet.
• Generate AI-based virtual try-on images and scene images using your avatar and clothing items.
• Access subscription tiers that include a system of credits used for AI generation and related features.

We may update, improve, or change the Service over time, including adding or removing features. We may also offer promotional or beta features that may be subject to additional terms.

3. Eligibility & Accounts

• You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
• You are responsible for providing accurate, current, and complete information when creating your account and for keeping your login credentials secure.
• You are responsible for all activities that occur under your account, including use of the Chrome extension connected to your account. If you believe your account has been compromised, you must notify us promptly at support@holocloset.com.

4. Subscriptions, Credits & Billing

HoloCloset may offer free and paid subscription tiers. Paid subscriptions may include monthly or annual plans and a system of credits that are used to access AI generation and related features.

• Subscription Plans. Details about current plans, included features, and prices are described in the app or on our pricing page. We may change plan offerings and prices from time to time, in which case we will provide notice as required by law.
• Auto-Renewal. Paid subscriptions typically renew automatically at the end of each billing period unless you cancel before renewal. By starting a subscription, you authorize us and our payment processor (such as Stripe) to charge the applicable subscription fees and any taxes on a recurring basis until you cancel.
• Credits. Certain features (including AI try-ons and scene generations) may consume credits. Your subscription may include a monthly credit allocation. Credits usage and availability are shown in the app. We may adjust credit policies and allocations over time.
• Cancellation. You can cancel your subscription at any time through the billing settings in the app or via the Stripe billing portal. When you cancel, you typically retain access to paid features until the end of the current billing period, and future renewals are stopped.
• Refunds. Except where required by law, all subscription and credit purchases are non-refundable. If you believe you have been charged in error, contact support at support@holocloset.com.
• Taxes. You are responsible for any applicable taxes associated with your purchases. We will charge taxes when required by law.

5. Chrome Extension

HoloCloset offers an optional Chrome extension that lets you capture images and metadata from third-party websites and send them to your HoloCloset account.

• The extension may request permissions such as access to the current tab and the ability to capture selected areas of the page in order to provide its functionality.
• When you use the extension to capture content, you direct us to create clothing items in your HoloCloset account using screenshots and basic metadata (such as the page URL, title, and product information that the extension can detect).
• You are solely responsible for ensuring that your use of the extension complies with the terms and policies of the sites you interact with and with applicable law, including copyright and other intellectual property laws.
• We are not affiliated with or endorsed by the third-party websites or brands from which you capture content and are not responsible for their content, product accuracy, availability, or policies.

6. User Content & License

"User Content" means any content you submit, upload, create, or capture through the Service, including photos, avatars, clothing and outfit images, try-on and scene images, tags, descriptions, and other metadata.

• You retain ownership of your User Content. These Terms do not transfer ownership of your content to HoloCloset.
• By submitting User Content to the Service, you grant HoloCloset a worldwide, non-exclusive, royalty-free, transferable, and sub-licensable license to host, store, reproduce, modify, process, and display that content as reasonably necessary to operate, improve, and provide the Service to you and other users (for example, to generate AI outputs for you, to show your outfits in the app, and to maintain backups).
• You represent and warrant that you have all rights necessary to submit the User Content and to grant the above license, and that the content does not infringe or violate any third-party rights or applicable law.
• We may remove or disable access to User Content that we believe violates these Terms, our policies, or applicable law, or that we reasonably consider harmful to the Service or other users.

7. Acceptable Use & Prohibited Activities

You agree not to misuse the Service. Prohibited activities include, without limitation:

• Using the Service for any unlawful purpose or to violate any applicable law.
• Uploading or generating content that is illegal, harmful, abusive, harassing, defamatory, hateful, or otherwise objectionable.
• Uploading or generating explicit sexual content or content involving minors or non-consensual imagery. We use content moderation and reserve the right to block or remove such content and suspend related accounts.
• Infringing or violating anyone's intellectual property, privacy, publicity, or other rights.
• Attempting to gain unauthorized access to the Service or related systems, probing or testing the vulnerability of any system, or circumventing any security or access-control measures.
• Scraping, crawling, or using any automated means (including bots or scripts) to access the Service in a manner that is not consistent with the normal operation of the app and extension.
• Reverse engineering, decompiling, or otherwise attempting to derive the source code of any part of the Service except where permitted by law.
• Using the Service to build a competing product or service or to benchmark our models or infrastructure without our prior written permission.

8. AI & Virtual Try-On Limitations

HoloCloset uses AI models to generate avatars, try-on images, and scene images. These results are synthetic approximations and have important limitations:

• AI outputs may not accurately reflect your physical appearance, body shape, dimensions, or skin tone, nor the true fit, color, or drape of clothing.
• Lighting conditions, image quality, poses, and other technical factors can affect results.
• AI outputs may contain artifacts, distortions, or other visual errors and should not be treated as professional advice.
• You should always rely on retailer sizing charts, product descriptions, and return policies when making purchase decisions, and not rely solely on AI visuals from HoloCloset.

By using AI features in HoloCloset, you acknowledge these limitations and agree that we are not responsible for differences between AI outputs and real-world appearance or fit.

9. Intellectual Property

The Service, including its design, text, graphics, logos, icons, software, and underlying technology, is owned by HoloCloset or our licensors and is protected by copyright, trademark, and other laws. Except for the limited license granted to you in these Terms, we reserve all rights in and to the Service.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use. You may not use the Service for any other purpose without our prior written consent.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, misused the Service, or created risk or possible legal exposure for us or other users.

You may stop using the Service at any time, and you may delete your account using the tools provided in the app. Upon termination or deletion of your account, the licenses granted to you under these Terms will end, but sections that by their nature should survive (such as intellectual property, disclaimers, indemnity, and limitation of liability) will continue to apply.

11. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components. We do not warrant the accuracy or completeness of any AI-generated content, try-on results, or information from third-party sites or products.

12. Limitation of Liability

To the fullest extent permitted by law, HoloCloset and its officers, directors, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Service or these Terms will not exceed the greater of (a) the amounts you paid to us for the Service in the six (6) months prior to the event giving rise to the claim or (b) one hundred U.S. dollars (USD $100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above exclusions and limitations may not apply to you.

13. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of the jurisdiction specified in the app or on our website, without regard to conflict-of-law principles. Where required by law, you may have protections under the laws of your place of residence.

Any disputes will be resolved in the courts or forums specified in our detailed legal notices or as otherwise required by applicable law. Nothing in these Terms limits any rights you may have to bring claims in your local courts or to raise issues with your local data protection authority where applicable.

14. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. In some cases, we may provide additional notice (such as in-app notices or email). Your continued use of the Service after any changes means you accept the updated Terms. If you do not agree to the changes, you must stop using the Service.
